Armed Attorneys Richard Hayes and Leslie Cross break down the DOJ’s new final rule restoring a long-dormant pathway for certain prohibited persons to seek federal firearms rights restoration under 18 U.S.C. § 925(c). After more than 30 years with effectively no functioning application process, the DOJ is preparing to reopen the door.
When can people actually apply? Who qualifies? What could automatically put you in a presumptive denial category? And what documents should you start gathering NOW?
The new rollout is expected to happen in stages:
* September 16, 2026: DOJ begins inviting candidates
* October 31, 2026: Public application opens for the first 5,000 applicants
* December 15, 2026: Another 500 applicants can apply and the application fee begins
Richard and Leslie also explain the five major presumptive-disqualification buckets, including pending sentences, serious violent offenses, certain 10-year and 5-year waiting periods, misdemeanor crimes of domestic violence, and prior denials.
Plus, they cover what applicants should begin collecting now—including criminal and court records, dispositions, charging documents, and three character references—before the application becomes available.
And Texans need to pay special attention: § 925(c) relief addresses the federal firearms disability, but Texas currently does not automatically recognize that relief under state law. Richard and Leslie explain what Armed Attorneys and Gun Owners of America are working on to potentially change that.
