Are You Eligible for an Expunction in Texas?
Texas law limits who can get a record expunged, but you may qualify if:
- An arrest for a crime that was never charged;
- A criminal charge that was ultimately dismissed;
- Certain qualifying misdemeanor juvenile offenses;
- Conviction of a minor for certain alcohol offenses;
- Conviction for Failure to Attend School;
- Arrest, charge, or conviction on a person’s record due to identity theft by another individual who was actually arrested, charged, or convicted of the crime;
- Conviction for a crime that was later acquitted by the trial court or the Court of Criminal Appeals; or
- Conviction for a crime that was later pardoned by the governor of Texas or the U.S. president.
Important: You generally cannot get an expunction if:
- You were convicted (except under limited circumstances);
- You received deferred adjudication (unless it was a Class C misdemeanor or certain UCW cases);
- You were placed on probation; or
- The statute of limitations has not yet expired for a dismissed felony.
What If You Don’t Qualify for an Expunction?
Non-Disclosure
If you’re not eligible for an expunction, you may still qualify for an Order of Nondisclosure, which seals your criminal records from public view. This means:
- Employers, landlords, and the general public cannot access your record
- Law enforcement and government agencies can still see it
- You can deny the record in most private-sector applications
