THE STORY THUS FAR
• 2012 — Pistol braces hit the market• March 5, 2014 — ATF says braces are legal, even if shouldered• Dec 15, 2014 — ATF confirms “blades” are OK
Then everything changed…
• 2023 Rule — ATF attempts to reclassify braced pistols as SBRs• Mock v. Garland (June 13, 2024)
* Rule found unlawful under the APA
* Injunction granted• July 2025 — Government drops appeal
BUT HERE’S THE PROBLEM…
Even after the rule was vacated:
• ATF is still enforcing existing NFA / GCA laws• Some braced pistols are STILL being treated like SBRs
From Texas v. ATF:
“Defendants continue to enforce the NFA’s and GCA’s regulation… even though the Rule has been vacated.”
Translation:👉 The rule is gone… but enforcement didn’t fully go away.
WHAT THIS MEANS FOR YOU
• Not all brace setups are automatically safe• ATF may still evaluate firearms under existing statutes• Legal risk depends on configuration, intent, and interpretation
