Armed Attorneys Emily Taylor and Richard Hayes break down a major new development in Zimmerman v. Blanche, a federal lawsuit challenging firearm restrictions inside National Park Service buildings.
The Department of Justice is asking the court to dismiss the case for lack of standing, arguing that lawful gun owners are not realistically at risk of prosecution. But there’s a catch: the federal law is still on the books, National Park Service guidance may still tell visitors firearms are prohibited inside visitor centers and other federal facilities, and the DOJ is relying on an Office of Legal Counsel opinion originally addressing post offices.
So where does that leave gun owners right now?
Emily and Richard explain what 18 U.S.C. § 930(a) means for National Park Service buildings, why DOJ says its current interpretation protects lawful carriers, why an OLC opinion is very different from a binding court judgment, and why the remaining conflict creates a serious legal gray area.
They also discuss the questions gun owners are actually asking:
• Can you carry inside a National Park visitor center right now?• Why is DOJ trying to dismiss the case instead of getting a Second Amendment ruling?• Is the Office of Legal Counsel opinion actually binding?• Could a future administration reverse DOJ’s position?• Does this reasoning apply to other federal buildings?• What about trails, campgrounds, and outdoor areas of National Parks?
The law may be moving in a gun-friendly direction—but when the statute, government guidance, signage, and DOJ’s enforcement position don’t all say the same thing, gun owners are left trying to figure out where the line really is.
